Paving company says man owes more than $100K

CHARLESTON – A paving company alleges a South Charleston man has failed to pay more than $100,000 for materials it delivered to him.

West Virginia Paving filed a lawsuit Aug. 20 in Kanawha Circuit Court against George Neilan.

In its complaint, West Virginia Paving alleges it entered into a contract with Neilan on Oct. 22, 2012, in which it agreed to provide materials, labor and services to Neilan.

However, since then, Neilan has failed to repay West Virginia Paving, according to the complaint.

"WVP is due the sum of $118,453 together with interest thereon at the legal rate for the materials, labor and/or services provided to George Neilan," the suit states.

In its complaint, WVP seeks repayment, plus costs, attorney fees, loss of interest and other relief the court deems just.

Norman T. Daniels Jr. and Ryan M. Hathcock of Daniels Law Firm in Charleston will represent it.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
