Asphalt company seeks payment from Ky. firm

WAYNE – An asphalt materials supplier is suing over claims a Kentucky blacktop company has failed to pay for materials purchased.

American Asphalt of West Virginia filed a lawsuit Sept. 11 in Wayne Circuit Court against Stevens Blacktop Inc.

According to the complaint, Stevens Blacktop requested and picked up goods and materials from American Asphalt's Wayne County location on many occasions between Sept. 7, 2012, and April 27, 2013, but has failed to pay for them. American Asphalt says Stevens Blacktop has unpaid invoices totaling more than $36,500 and more than $9,800 in interest.

American Asphalt seeks more than $46,400 in damages plus attorney fees.

It is represented by attorney George B. Morrone III of Mundy & Associates in Huntington. The case has been assigned to Circuit Judge James H. Young Jr.
