Woman blames nursing home for sister's death

CHARLESTON – A Kanawha County woman is suing over claims her sister sustained injuries that allegedly contributed to her death in a nursing home.

Sandra Loftis, as personal representative of the estate of Wilma Mae Mobley, deceased, filed a lawsuit Oct. 7 in Kanawha Circuit Court against 1000 Association Drive Operations, doing business as Oak Ridge Center, and Genesis Healthcare, citing negligence.

According to the complaint, Mobley was a resident of the defendants' facility, Oak Ridge Center, from Oct. 25, 2012, until Oct. 29, 2012, during which time she sustained injuries, including a fall, urinary tract infections and aspiration pneumonia, due to poor care and neglect. The complaint states these injuries contributed to her death.

According to the lawsuit, the defendants were aware of problems with patient care due to inadequate staffing and supplies. The defendants are accused of statutory violations in failing to provide sufficient staff and, thus, adequate care to its residents, negligence, ordinary negligence and reckless misconduct and wrongful death.

Loftis seeks damages and attorney fees.

She is represented by attorneys Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm in Charleston. The case has been assigned to Circuit Judge Louis "Duke" Bloom.
