CHARLESTON – A Kanawha County woman is suing over claims her doctor failed to follow up with abnormal test results, causing a delayed cancer diagnosis.
Lana Y. and R. Gregory McVey filed a lawsuit Oct. 8 in Kanawha County Circuit Court against Ronald S. Jones, M.D., citing negligence.
According to the complaint, Lana McVey underwent a pap smear that tested positive for cell abnormality on March 6, 2012, but Jones, her gynecologist, failed to follow up on the findings. The complaint states another doctor performed a pap smear with abnormal results on July 15, 2013, and McVey underwent a cervical biopsy on Aug. 23, 2013, and was diagnosed with stage II-B cervical cancer in September 2013.
Jones is accused of negligence in failing to investigate the abnormal pap smear results or take into account previous abnormal results in McVey's medical history, thus further depriving McVey of a chance of recovery. McVey says she has incurred medical expenses in excess of $100,000, including radiation, chemotherapy, and surgery.
R. Gregory McVey is suing for loss of consortium.
The McVeys are being represented in the case by attorneys Robert V. Berthold Jr. and Holly G. DiCocco of Berthold Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Paul Zakaib Jr.
