Woman blames nursing home for mother's injuries, death

CHARLESTON -- A Kanawha County woman is suing over claims her mother was injured and eventually died in a nursing home.

Linda Mundy, on behalf of the estate of Elizabeth Postle, filed a lawsuit Dec. 15 in Kanawha Circuit Court against: Genesis Healthcare; Sun Healthcare Group Inc.; SunBridge Healthcare; Sabra Health Care REIT Inc.; SHG Services Inc.; Sunbridge Care Enterprises Inc.; Care Enterprises Inc.; Sunbridge Dunbar Health Care Corp.; John Does 1 through 10; and unidentified entities 1 through 10 (as to Dunbar Care and Rehabilitation Center).

According to the complaint, in 2010 Postle became a resident of Dunbar, where she later sustained injuries, including falls, a hip fracture, urinary tract infection, dehydration, malnutrition and pressure sores, and eventually died as a result of these injuries Dec. 16, 2012. The defendants are accused of corporate negligence and fraud for assuring Postle's family she would receive the proper care while being aware of the systematic problems at the facility due to staffing and budget restrictions.

Mundy seeks damages and costs of litigation. She is represented by attorneys James B. McHugh, Michael J. Fuller Jr., D. Bryant Chaffin and Kendra R. Fokakis of McHugh Fuller Law Group of Hattiesburg, Miss.
