NEW CUMBERLAND – A Weirton man is suing the parks and recreation board over claims he fell on a metal cover in the swimming pool area.
Kevin Childers filed a lawsuit Jan. 23 in Hancock Circuit Court against the Weirton Board of Parks and Recreation.
According to the complaint, on Jan. 17, 2013, Childers slipped and fell on a metal cover in the walkway while at the Starvaggi Memorial Pool and Park. The Weirton Board of Parks and Recreation negligently failed to inspect the area and failed to properly install the metal cover to ensure it was slip proof, the suit states, and failed to maintain the pool area, causing a hazard.
Childers sustained severe injuries due to the fall, the suit states.
He seeks damages for all injuries suffered, along with lost wages, interest and costs. Childers is represented by attorney Teresa C. Toriseva of Toriseva Law in Wheeling.
