NEW CUMBERLAND — A Hancock County woman has sued a city government and two individuals for alleging causing personal injury.
Whitney Abbaspour filed a lawsuit Jan. 29 in Hancock Circuit Court against the city of New Cumberland, Barbara J. Sirotnik and John Doe, alleging gross negligence.
According to the complaint, on Oct. 4, 2013, Abbaspour fell while walking on property owned by Sirotnik at 903 Second Ave., New Cumberland. The defendant “John Doe” is defined as corporations, entities, governmental units, political subdivisions or persons responsible for city sidewalk maintenance, the suit states.
The plaintiff argues the defendants were aware of and willfully failed to inspect, repair and keep the sidewalk safe or warn pedestrians of the hazard. The suit cites deliberate indifference, recklessness and willful misconduct.
Abbaspour seeks: damages for head, wrist, hand, face and other injuries; bruising, headaches and muscle damage; medical expenses, pain and suffering, distress; attorney fees; and costs. She is represented by attorneys Vincent Gurrera of Gurrera Law Office, and Amanda Mesler of Isla Mesler Law Offices, both in Weirton.
The case has been assigned to Circuit Judge Ronald E. Wilson.
