Man blames Genesis for nursing home negligence

CHARLESTON – A Fayette County man is suing Genesis Healthcare after he claims his sister was a victim of nursing home negligence.


Hidden Valley Center was also named as a defendant in the suit.


Violet Ballard was a resident at Genesis' Hidden Valley Center from Nov. 8, 2012, through Dec. 18, 2012, according to a complaint filed Jan. 9 in Kanawha Circuit Court.


Larry Ballard claims during her time under the defendants' care, Violet Ballard suffered abuse, neglect and mistreatment.


The negligence and carelessness of the professionals and non-professionals of the defendants' contributed substantially in causing serious injuries to Violet Ballard, resulting in pain and suffering, and ultimately her death, according to the suit.


Larry Ballard claims his sister had the right to adequate and appropriate healthcare and the defendants did not provide that.


The defendants breached their duties to Violet Ballard in many ways and led or contributed to her death on July 31, 2013, according to the suit.


Larry Ballard is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart of the Bell Law Firm PLLC.


The case is assigned to Circuit Judge Jennifer Bailey.
