Phone book publisher seeks payment

WHEELING — A Pennsylvania phone directory firm has sued a Wheeling business, alleging breach of a 2012 contract.

Ogden Directories Inc. doing business as a EZToUse.com, of Altoona, Pa., filed a lawsuit Feb. 2 in Ohio Circuit Court against Wheeling Area Private Duty, doing business as Right at Home In Home Care & Assistance, alleging nonpayment of its contractual obligations.

According to the complaint, Ogden Directories signed contracts with the plaintiff in August 2012 for advertising representation in its periodical publication. The suit states Ogden satisfied the terms of the contract by publishing Right at Home’s information as promised in its directory, and Right at Home failed to make its agreed monthly installment payments.

The plaintiff alleges the defendant has amassed a total principal amount of $23,338.23.

Ogden Directories seeks reimbursement of the principal, plus attorney fees and costs, which currently total $5,473.80, and interest at the legal rate of 7 percent per annum dating to May 17, 2014.

The plaintiff is represented by attorney John Keating of Amato Keating and Lessa in Bethlehem, Pa. The case has been assigned to Circuit Judge Martin J. Gaughan.
