CHARLESTON – A Kanawha County man is suing Genesis Healthcare and Oak Ridge Center for injuries his mother sustained prior to her death.


Mary Bowen was a nursing home resident of the defendants from Aug. 23, 2013, until Nov. 9, 2013, according to a complaint filed in Kanawha Circuit Court.


Timothy Bowen claims his mother suffered  urinary tract infections and other infections during her residency and she was not properly hydrated.


The defendants failed to provide the necessary amount of fluid to Mary Bowen so as to prevent dehydration and the defendants failed to implement a plan of care to prevent and treat her risk of dehydration, which resulted in acute renal failure, according to the suit.


Timothy Bowen claims his mother also suffered from malnutrition and the defendants failed to implement the dietary suggestions made by the dietitian.


The negligence and carelessness of the professionals and non-professionals of Oak Ridge Center contributed substantially in causing serious injuries to Mary Bowen, resulting in pain and suffering and, ultimately, her death.


Timothy Bowen claims the defendants were negligent and breached their duty to his mother.


Mary Bowen died on Nov. 9, 2013, as a result of the systemic abuse and neglect causing significant injuries she sustained while in the defendants care, according to the suit.


Timothy Bowen is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart of the Bell Law Firm.


The case is assigned to Circuit Judge Joanna Tabit.
