* The National Check Bureau says the defendant has failed to make payments for a credit card agreement with Chase Manhattan Bank for a FUSA - First Card - Platinum. The plaintiff says the defendant owes a total of at least $13,573.93, plus court costs and interest. A jury trial is requested.

Vicki D. Ford vs. 7-Eleven Inc.

* Ford says she went to a 7-Eleven store near Kearneysville on Aug. 5, 2005, and slipped on water that had apparently leaked from an air conditioning unit. The suit claims 7-Eleven was negligent, and the company's employees should have exercised reasonable care to keep the premises in a safe condition. Ford was injured when she slipped on the water, and she is asking for compensation for her medical expenses and injuries, as well as interest, court costs, attorney fees and other relief. The suit did not specify the plaintiff's injuries. A jury trial is requested.

Conseco Finance Servicing Corp. vs. Michaela S. Hilley

* The Conseco company says Hilley secured her mobile home as a collateral for a promissory note in the amount of $16,910, and she is now delinquent upon the debt. The plaintiff is asking that the court grant possession to the Conseco company. The plaintiff also asks that the defendant remove all personal property from the home within a reasonable amount of time. A jury trial is requested.

Donald E. Newcomb, III vs. The estate of Christopher Scott Raney and Images Club Inc.

* Newcomb says Raney caused a car accident with him on W.Va. 51 on Jan. 23, 2004, after Raney had been drinking alcohol at Images Club in Berkeley County. The plaintiff says Raney was speeding, driving under the influence of alcohol and failed to maintain control of his vehicle. Raney died the day after the accident. Newcomb says he has suffered serious and permanent injuries because of Raney's negligence, as well as the negligence of employees at Images Club who served Raney alcohol even though he was visibly intoxicated. Newcomb is asking for compensatory damages in excess of $1 million, plus interest and court costs, and he is requesting a jury trial.

* The plaintiffs say the defendant, who is their step-father, breeched his fiduciary duty as executor of their mother's will. They say the defendant filed an estate appraisal of $1,370,650 in April 1999. As of May 31, 2005, the estate only had assets of $676.42. The plaintiffs say the defendant violated his duty as executor of the will, failed to close the estate and used the assets for himself. They are asking for the defendant to be made accountable for every transaction he made on behalf of the estate, that he have a constructive trust imposed on all his property acquired as a result of his wrongful conduct, punitive damages, court costs, attorney fees and any other relief the court deems just and proper. They request a jury trial.

Berkeley County Public Schools Federal Credit Union vs. Ray L. Miller

* The credit union says Miller entered a contract and security agreement that was secured by a motor vehicle. The defendant defaulted on the terms of the agreement and the security was repossessed and sold. However, the plaintiff says there is a remaining balance of $21,627.30. The credit union is asking for that amount plus interest, court costs, fees and other relief, and a jury trial is requested.

* The Embassy claims Graham Michael had a scheme to defraud the Embassy and the government of Papua New Guinea when he worked as a senior diplomat. The suit claims Michael deliberately defrauded the plaintiff and obtained at least $94,000. The plaintiff seeks to recover fraudulently obtained funds from Michael and his wife, as well as property they obtained with those funds. The Embassy requests a jury trial.

* Palmer says Greenfield, who is her father, breeched his fiduciary duty as executor of her mother's will. The plaintiff says the defendant did not give her the items, proceeds or trust fund from the estate as outlined in the will, and she claims Greenfield used assets from the estate and the plaintiff's trust for his own use. She requests that the defendant to be made accountable for every transaction he made on behalf of the estate and the trust, that he pay all sums owed to her and that she be awarded general and punitive damages, court costs, attorney fees and other relief. She requests a jury trial.

* Cardinal says Aero-Smith breached a lease and management agreement by failing to pay all rent owed for Cardinal's hangar at the Eastern West Virginia Regional Airport and failing to properly manage the premises by leasing space to third parties in violation of the agreement. Cardinal says the defendant owes at least $61,619.34 for rent, plus at least $7,976.24 for failing to pay personal property taxes according to their agreement. The plaintiff is asking for full accounting of all of Aero-Smith's transactions pertaining to the hangar, as well as compensation for the unpaid rent, taxes, lost profits, court costs, attorney fees, interest and other relief. A jury trial is requested.
