Woman sues after she say she bit pebble in popcorn

WHEELING - A woman is suing Wheeling Island Gaming, Inc., and Poppee's Popcorn, Inc., after mistakenly biting into a pebble that was present in her food.

Cheryl Marshall filed the suit last month in Ohio County.

In the suit, filed by Jacob M. Robinson, Marshall claims that while at Wheeling Island Racetrack and Gaming Center, she bought food from "Jenny's Popcorn," a company of Poppee's Popcorn, Inc. While eating the contents, she bit into a small pebble.

As a result of the incident, Marshall claims she has suffered possible permanent injuries to her tooth and mouth and has suffered great pain of body and mind. She has been forced to pay for medical care and while being treated, she has lost income due to her absence from work. She is suing the defendants for compensatory and punitive damages

She seeks a trial by jury.

The case has been assigned to Circuit Judge James P. Mazzone.
