HUNTINGTON – The parents of five Cabell County middle school students are suing two Cammack Middle School administrators and the Cabell County Board of Education, claiming they negligently accused the children of "butt-raping" another student.
In a suit filed Feb. 21 in the Cabell Circuit Court, the parents of the five children accuse Vice Principal Rebecca Monday and Principal Mary A. Freeman of filing the sexual harassment complaint without any investigation or notice to the children's parents.
The complaint, which was filed in February 2004, claims the five children anally raped another student. The charges were later dismissed as untrue.
The suit claims the complaint was made without proper notification of the parents who found out about the allegations by letters in the mail from the Juvenile Referee's Office of Cabell County.
The children's parents allege the principal and vice principal were in violation of state and county procedures by not performing a proper investigation into the reported allegations and not discussing the complaint with them.
As a result of the negligence, the suit claims the children incurred emotional distress, humiliation and mental anguish.
The parents are seeking punitive damages.
