Coal seller owes allegedly more than $1 million

CHARLESTON - A Hansford-based coal mining company is suing Doug Brown, the principal shareholder of Point Service Coal Sales, for over $1 million that he said Brown has remaining on his balance.

Pritchard Mining Company says in a lawsuit filed March 24 in Kanawha Circuit Court that Brown, who purchased the coal then resold it, paid a small amount of his balance but has a lot left.

Brown, of St. Albans, is charged with breach of contract, misrepresentation, fraud in the inducement, conversion, guaranty and coobligor, disregard of corporate entities and causation.

Pritchard, which is represented by George A. Patterson III, claims that it has demanded but payment but has not received it.

The company says the two agreed on a price of $1,152,912.16 for coal Brown purchased from Aug. 9-Jan. 6.

A sum of $100,000 was paid at that meeting, and a payment of $50,000 was paid five weeks later.

Since then, Pritchard says it has received no money and claims to be owed $1,002,912.16.

Pritchard is also seeking compensatory and punitive damages.

Judge Tod Kaufman has been assigned the case.
