Poca woman sues after mishap at grocery store

WINFIELD – A Poca woman is suing after a mishap at her hometown grocery store.

Bonnie Louk filed the lawsuit March 22 in Putnam Circuit Court. She lists Forth Inc. dba Poca Food Fair and M.C. Inc. as the defendants. M.C. Inc. leases the building to Forth/Food Fair.

On April 5, 2004, Louk says she was shopping at the store. When she was leaving the store, she says her buggy fell into a hole while exiting the store and causes her to suffer severe injuries.

In her suit, filed by attorney Phillip M. Stowers, Louk claims the defendants were negligent because they knew or should have known of the unsafe and dangerous condition that would have been caused by failing to warn consumers of the hazardous condition, they failed to take reasonable precautions to prevent unsafe condition and had a duty to take reasonable precautions to prevent injuries.

Louk seeks damages for pain and suffering, mental anguish, loss of ability to enjoy life and substantial medical expenses. She says all of those will continue in the future. She also seeks pre- and post-judgment interest, court costs, attorney fees and other relief.

The case has been assigned to Judge O.C. "Hobby" Spaulding.
