WHEELING - A Wheeling woman who says she believes she slipped in vomit is suing the bar at the Wheeling City Center Hotel for her damages.

Amy Wolfe and husband Charles filed the lawsuit April 24 in Ohio Circuit Court against Wheeling City Center Hotel, doing business as Rio Lounge.

The Wolfes are represented by David Jividen of Jiveden Law Offices in Wheeling and are seeking $300,000.

On Feb. 20, 2005, Wolfe says she "while walking toward the restroom of the Rio Lounge stepped in a pile of an unknown substance believed to be human vomit, which caused her to slip."

She adds that she fell violently to the ground and was covered in the substance.

The complaint says Rio Lounge was hosting a function for Wheeling Catholic Central High School and that many of those attending were believed to have been intoxicated, leaving Rio Lounge staff too busy to attend to the pile of vomit.

"As a proximate result of the defendant's negligence, the plaintiff suffered injuries of her head, left hand, left wrist, left arm, left shoulder and various other parts of her body," the complaint says.

She also says she suffered humiliation and loss of personal dignity, as well as her clothes being damaged.

Her husband is suing for loss of consortium in the amount of $100,000. Amy Wolfe is seeking compensatory damages in the amount of $200,000.
