Woman sues driver, says he ran over her foot

HUNTINGTON - A woman is suing the owner and driver of a car that she says ran over her right foot as she crossed 10th Street in Huntington.

Geraldine Owens filed the lawsuit May 8 in Cabell Circuit Court against Howard and Norman Glaser through attorney Michael Woelfel, whose office is located on the same street on which Owens claims the incident occurred.

Owens says she was crossing the street on Sept. 13 when Howard Glaser, attempting to make a right turn, ran over her foot with a 2000 Ford Focus.

She charges Howard with being negligent, reckless and careless in operating the automobile with disregard for the safety of others, failing to keep a proper lookout for pededstrians, failing to maintain control of his vehicle and failing to exercise due care.

"As a direct and proximate result of the negligence of Defendant Howard J. Glaser ... Plaintiff suffered severe and permanent bodily injuries and said injuries have caused the plaintiff extreme physical and mental pain and suffering and will cause her to suffer the same in the future," the complaint says.

Owens adds that Norman Glaser is "vicariously liable and responsible in damages" as the owner of the car. She says Howard acted as the agent of or with the permission of Norman.

She is seeking compensatory damages.

Judge John L. Cummings has been assigned the case.
