The plaintiffs are challenging the Zoning Board's denial of their application for the development of 540 acres in Jefferson County.

Blue Haven Construction Co. Inc. v. Mike Bauer

* Blue Haven contends that Bauer entered into a written contract on Aug. 20, 2004, for construction of a swimming pool at his Kearneysville home. The quoted cost was $54, 250 for excavation, material and labor associated with pool. Blue Haven claims Bauer still owes $21,300. The company is asking for payment of contractual attorney fees at an interest of 18 percent per annum. In addition, Blue Haven is seeking damages for extra additional payroll costs, overhead costs, home office costs, loss of profit, less of interest on amount due and damages to the company's reputation. Blue Haven is demanding a trial by jury.

Tonya L. Racanelli as friend of Joshua Patterson v.
PNGI Charles Town Gaming LLC

* Case is stems from a June 2004 incident in the horse stables at Charles Town Races & Slots. Racanelli was employed as a groom for her husband who's a trainer at the racetrack. In June 2004, she was bitten by a kitten at the stables. A week later, she was bitten by
the kitten again and her son was also bitten. The kitten was tested for rabies and found to be positive. Racanelli and her son needed medical attention to which PNGI allegedly promised to pay for her medical expenses. Racanelli contends she still needs medical care and treatment in relation to the rabies bite and rabies treatment. She claims PNGI has failed to pay any of her medical expenses. She is seeking compensatory damages according to proof, plus costs, pre-judgment and post-judgment interest and reasonable attorney fees.
