Man says grease at KFC caused fall

MARTINSBURG - An Inwood man says he slipped in some grease at a KFC in Martinsburg.

Doug Files entered a lawsuit July 5 into Berkeley Circuit Court against Yum! Brands, doing business as KFC.

On July 5, 2004, he says he slipped in grease and water and fell on his way to the restroom.

"While going to use the restroom, Doug pushed the swinging door dividing the restroom from the restaurant and stepped through the doorway into a pool of grease and water that had been allowed to collect on the floor in the restroom and slipped and fell," the complaint says.

Files describes the wet floor as a "hidden danger, trap, snare or pitfall."

He claims to have sustained physical and emotional injury, as well as property loss and lost wages, as a result of KFC's negligence.

He says KFC knew or should have known of the existence of the wet spot.

Michael Santa Barbara of Martinsburg law firm Santa Barbara Law Offices is representing him.

Judge David Sanders has been assigned the case.
