Beer slip broke leg, suit says

CHARLESTON - A man says he broke his leg last October at the Charleston Civic Center and is suing the city.

Michael Blankenship is also suing Boston Culinary Group doing business as Distinctive Gourmet in a lawsuit filed Oct. 4 in Kanawha Circuit Court.

At a Rascal Flatts and Blake Shelton concert, Blankenship says he slipped and fell on a puddle of beer near a beer concession stand.

Blankenship says he was "seriously and permanently injured" and that the defendants breached their duty to keep him safe.

As a result, he says he suffered a fracture to the left distal femur and has incurred medical expenses of more than $29,000.

In addition to medical expenses, he seeks compensation for pain and suffering, loss of the enjoyment of life, loss of wages and loss of earning capacity.

Wife Misty says she has lost consortium with her husband and is seeking compensation.

Bruce Freeman of Freeman and Chiartas in Charleston is representing the plaintiffs.

Judge James Stucky has been assigned the case.
