Woman sues over alleged deadly hunting accident

MORGANTOWN - A Monongalia County woman representing the estate of a man alleged to have been shot while hunting is suing the alleged shooter.

Tina Marie Hawkins filed the suit on behalf of husband Randall's estate and their daughter, Ally, Nov. 16 in Monongalia Circuit Court against Curtis Davis.

Hawkins says that Randall was hunting in the area known as "Indian Creek Road" in Monongalia Circuit Court on April 28, 2005, in roughly the same area Davis was.

"In so hunting as aforesaid, Defendant Curtis Davis negligently discharged his firearm and shot Randall F. Hawkins," the complaint says.

Hawkins claims that the loss of her husband has caused her and her daughter the loss of the reasonably expected income, services, protection care and assistance that Randall would provide.

It adds that the two have suffered sorrow and mental anguish. They seek compensatory damages for those things, as well as funeral expenses and loss of enjoyment of life.

Morgantown attorney Edmund Rollo is representing Hawkins.

Judge Russell Clawges has been assigned the case.
