Man says he was fired for complaining

WHEELING - An Ohio man says he was fired from job at a plastics company for complaining about his work environment.

Roy Surratt of Bellaire says his termination by RXI Plastics, Inc., was retaliatory and filed suit against it Dec. 15 in Ohio Circuit Court.

Silgan Plastics Corp. and Joseph Kibert are also listed as defendants.

Surratt says he worked for RXI at a plant in Triadelphia from August 1992-Dec. 20, 2004. Kibert was a supervisor at the plant, and Surratt alleges that he reported to Kibert that a supervisor was using inappropriate, offensive, demeaning and/or threatening language.

Surratt also says that he had made complaints about his workplace conditions and taken some time off just prior to his termination.

He claims he was fired "because he exercised his right to register complaints in the workplace regarding inappropriate and harsh treatment by a supervisor."

He charges the defendants with retaliatory discharge and perceived disability discrimination.

Surratt seeks compensatory damages for humiliation, embarrassment, degradation, emotional and mental stress, anxiety, annoyance and inconvenience, as well as monetary damages.

He also seeks punitive damages.
