Parents blame four Morgantown men for son's death

MORGANTOWN - The parents of a Monongalia County man are suing four Morgantown residents, claiming they are responsible for the death of their son.

Nancy L. Harvey and Jeffrey S. Harvey filed a suit Dec. 18 in Monongalia Circuit Court against Kenneth Lee Burns, Tyref Byson McNeal (aka Beans), Walter Duane White and Nathan John Philmore.

In the complaint, they say the defendant' negligence and reckless participation in illegal drug use caused the death of Brandon Harvey.

On Dec. 16, 2006, Brandon Harvey died "as a result of illegal and/or narcotic drugs that were provided to him on or about said date either directly or indirectly by the defendants."

Kenneth Burns entered a guilty plea in U.S. District Court to Possession with Intent to Distribute Heroine and Cocaine Base; Walter White entered a guilty plea to Distribution of Heroine; Tyref McNeal entered a guilty plea to Aiding and Abetting in the Possession with Intent to Distribute Cocaine and Heroine Base; Nathan Philmore entered a guilty plea to Possession with Intent to Distribute Heroine and Cocaine Base.

Nancy Harvey and Jeffrey Harvey are seeking compensation from the defendants, including compensation towards their son's daughter, a minor, for the loss of income, services, protection, care and assistance.

The Harveys also reserved the right to amend their suit as further information is made available through discovery.
