Boy injured by power line, suit says

MARTINSBURG - A Berkeley County woman has filed a suit against a power company on behalf of her son.

Kimberly A. Hurley, the mother of Marvin Hurley II, is suing Potomac Edison Company dba Allegheny Power because of negligence on the power company's part, which caused severe injury to the boy.

On Sept. 27, 2005, Marvin Hurley II was playing in leaves on his aunt's property. While playing, he came into contact with an uninsulated power line and "was caused to be injured in and about his body, body chemistry and psyche."

The suit states the injuries are permanent.

Hurley is suing Allegheny Power because the company did not exercise ordinary care in inspecting the line and should have taken some action to notice the "dangerous proximity of the line to the foliage on the property."

The suit states Allegheny Power violated governmental rules, regulations and standards, including the National Electrical Safety Code.

Hurley is seeking financial compensation for the injuries her son sustained as well as punitive damages.

The suit was filed Dec. 15 and has been assigned to Judge David Sanders.
