Couple says Fleetwood wouldn't fix damaged mobile home

CHARLESTON - A Kanawha County couple is suing the manufacturer, retailer and dealer of a mobile home they purchased.

Harold and Kelly Taylor filed the lawsuit Feb. 5 in Kanawha Circuit Court, against Fleetwood Homes, Fleetwood Retail Corp. of West Virginia and CMH Homes.

In January 2005, the Taylors say they bought a new Fleetwood mobile home. There was a warranty on the home, which covered any repairs or replacements needed during the warranty period.

During the delivery and installation of the home, the suit says the home was damaged and not properly installed. The Taylors discovered the problems after they moved into the home.

The suit says despite the Taylors effort to allow repairs, Fleetwood Homes failed or refused to repair it.

In an eleven-count complaint, the Taylors ask the court to order the defendants to establish a consumer rights training program for their employees. They also seek compensation for financial losses and punitive damages and actual damages for violation of West Virginia Consumer Credit and Protection Act.

Attorney Kristina Thomas Whiteaker is representing the Taylors, and the case has been assigned to Judge Charles King.
