Couple says Kmart to blame for woman's parking lot fall

CHARLESTON - A Kanawha County couple blames Kmart after the wife fell and was injured in parking lot of the retailer's Kanawha City location.

Sharon and Raul Olivares filed a suit April 3 in Kanawha Circuit Court, against K-Mart Corporation.

On June 22, 2006, Sharon Olivares fell on gravel that had been swept into a pile, which she claims was difficult to see, near the store's entrance.

As a result, she suffered severe injuries to her right shoulder and knee, the suit says. She incurred medical expenses of more than $19,900, and she has suffered a loss of income in an amount in excess of $25,000, the suit says. She has also suffered pain that is expected to be permanent.

Raul Olivares claims he suffered a loss of care, comfort, companionship and consortium of his wife.

Together, through Nitro attorney Harvey Peyton, they demand compensation for the injuries and other relief. The case has been assigned to Judge Charles King.
