Games-Neely claims Overington exceeded her legitimate powers by denying the motion without conducting an evidentiary hearing.

* The petitioner is seeking a writ of certiorari in regard to the Planning Commission's decision to approve the supplemental plat of a commercial land development unit. Bonner, who was the project's developer, claims the Planning Commission should not have approved the plat because the site did not meet stormwater management regulations. He is seeking that the court reverse the decision.

The Millers claim they have suffered because of Stephen Miller's permanent injuries that resulted from the accident, and they are seeking an undetermined amount of relief.
