Pamela Jean Games-Neely vs. Honorable JoAnn Overington, Berkeley County magistrate
PA - Christopher Quasebarth; J - Gray Silver
* Games-Neely, Berkeley County prosecuting attorney, is seeking an order prohibiting Overington from enforcing her ruling in regard to a law firm's representation. Games-Neely claims the firm Mills and Wagner PLLC should be prevented from representing defendants in two cases, and a motion to that effect was denied by Overington. Games-Neely claims Overington exceeded her legitimate powers by denying the motion without conducting an evidentiary hearing.

Daniel P. Bonner, petitioner vs. The Berkeley County Planning Commission
PA - Linda Gutsell; J - David Sanders
* The petitioner is seeking a writ of certiorari in regard to the Planning Commission's decision to approve the supplemental plat of a commercial land development unit. Bonner, who was the project's developer, claims the Planning Commission should not have approved the plat because the site did not meet stormwater management regulations. He is seeking that the court reverse the decision.

Warren C. Rowland vs. Stephen Paul Miller
PA - Christopher Janelle; J - Gray Silver
* Rowland claims Miller was reckless and caused a May 24, 2005, vehicle accident. Rowland claims the head-on collision was the result of Miller crossing the center line of W.Va. 9, and the plaintiff suffered serious injuries. He is seeking $1 million in compensatory damages.

Stephen Paul Miller and Karen A. Miller vs. Warren C. Rowland
PA - Wesley Metheney; J - Christopher Wilkes
* Stephen Miller claims Rowland was reckless and caused a May 24, 2005, vehicle accident. Miller claims Rowland crossed the center line on W.Va. 9 and struck him head on. The Millers claim they have suffered because of Stephen Miller's permanent injuries that resulted from the accident, and they are seeking an undetermined amount of relief.
