Man accuses former employer of age discrimination

CHARLESTON - A Kanawha County man filed a suit against his former employer, claiming he was fired because of his age.

Archie L. Walker Jr. filed a suit July 24 in Kanawha Circuit Court against Pomeroy IT Solutions Sales Company, a business based in Hebron, Ky. The company also has a location in Kanawha County.

Walker claims Pomeroy employed him for about nine and a half years before he was "willfully, maliciously and unlawfully" fired March 6, 2007. He claims his discharge was due in part to his age, which is a violation of the West Virginia Human Rights Act.

Walker also claims his wages and fringe benefits were not paid within 72 hours of his discharge.

According to the suit, Walker seeks lost wages and benefits, back pay, front pay, damages for indignity, embarrassment, humiliation and emotional distress and punitive damages.

Attorney Mark A. Atkinson is representing Walker. The case has been assigned to Judge James Stucky.
