Martinburg grocer sued after woman slips in puddle of water

MARTINSBURG - A Berkeley County woman is suing a local grocery store after she slipped on a puddle of water in the store.

Patricia Dick filed a suit July 20 in Berkeley Circuit Court, against Giant Food Stores, doing business as Martin's Grocery Store, located at 901 Foxcroft Ave. in Martinsburg.

According to the suit, Dick went to the store July 20, 2005, to buy groceries.

"While walking away from the check out line, Patricia stepped into a pool of water that had been allowed to collect on the floor," the suit says.

Dick then slipped and fell, and was injured.

According to the suit, the grocery store allowed to water to pool on the floor, which is under the category of a hidden danger, trap, snare and pitfall.

Dick claims that she was unaware of the pooled water, and because of her fall has suffered injury to her body, body chemistry and psyche.

Dick seeks damages in an amount to compensate her for her injuries.

Attorney Michael Santa Barbara is representing Patricia Dick. The case has been assigned to Judge Gray Silver.
