Woman blames city after falling and hitting metal post

CHARLESTON - A Kanawha County woman has filed a suit against the City of Charleston after she fell on a sidewalk and her face hit a metal post.

Patricia M. Thompson filed a suit Sept. 24 in Kanawha Circuit Court, against Charleston and John Doe Property Owner.

According to the suit, Thompson was walking on Court Street on March 4, 2006, when she stumbled "as the result of the improperly maintained sidewalk."

Thompson began to fall and hit her face on a metal lamppost as she fell, sustaining extensive injuries.

The report from the Charleston Fire Department says Thompson tripped from a hole in the sidewalk due to missing bricks. The hole was about 14 inches square.

Thompson was taken to the emergency room at Charleston Area Medical Center's General Hospital, where she was treated.

According to the suit, Thompson claims the city has a duty to maintain the sidewalks in a safe condition and freed from nuisance, which they failed to do.

Thompson seeks compensatory and punitive damages.

Attorney J.C. Powell is representing Thompson. The case has been assigned to Judge James Stucky.
