Christopher Puccio v. Apple American Group dba Applebee's Restaurant in Morgantown

* In November 2005, West Virginia University student Puccio and some friends went to Applebee's for dinner. As he was ordering, he was specific in letting the server know he had a severe allergy to seafood. He explained that he had suffered an allergic reaction when dining in there some months before. The server let him know that his food would be prepared without any contact with seafood. Because undue care had been taken in his food preparation, Puccio became extremely ill, required immediate medical attention and was admitted to the hospital. As a result, Puccio sustained serious injury and function to his knee. He is seeking judgment for general damages, medical and related expenses, damages for loss of earnings, interest and court costs.
