* In Feburary 2007, Moore and Crites were guests of a tenant that leased an apartment from Crest Point. Crites attacked and tackled Moore near the second floor railing in front of the door to the apartment where Moore and Crites were guests. Both Moore and Crites fell through the railing and onto the paved parking lot below. Moore alleges that Crest Point was negligent in that the railing was substandard. He is seeking judgment from both Crites and Crest Point for compensatory damages; past, present and future medical expenses; general damages; pre- and post-judgment interest; court costs and attorney fees.

* While attending a concert at the 84 Lumber Classic at Nemacolin Woodlands Resort, Recbecca McDonald and her minor child were injured during an altercation. McDonald is seeking judgment for compensation of damages incurred, medical costs, pain and suffering, loss of income, plus any costs and interest.
