Woman claims Ruby Hospital staff assaulted her

MORGANTOWN - A Marion County woman has filed a suit against a local hospital, claiming security guards and doctors at the hospital assaulted her.

Darla J. Hurst filed the suit Dec. 3 in Monongalia Circuit Court. Her daughter, Meagan Goff, is also named as a plaintiff.

The suit is against West Virginia University Hospital, doing business as Ruby Memorial Hospital.

Hurst claims she went to the hospital Feb. 23, 2007, seeking medical services. While there, she claims she was physically attacked and unlawfully restrained by Chris Harper, a defendant.

Dr. Charles Whiteman, K. Porter and Charity Warner are also named as defendants.

Hurst claims the assault and battery was intentional and perpetrated by the defendants in complete disregard of her personal rights and wishes.

In the seven-count suit, Hurst seeks compensatory and punitive damages for physical pain, emotional distress, aggravation, annoyance and inconvenience, humiliation, embarrassment, fear and fright and loss of enjoyment of life.
