CHARLESTON - The father of a Sissonville boy who was beaten on school grounds has filed a suit against the Kanawha County Board of Education, seeking awards for his son's injuries.
Mark Morris filed the suit Jan. 9 in Kanawha Circuit Court on behalf of his son Robert Morris.
According to the suit, Robert Morris was a student at Sissonville High School on Sept. 16, 2005. Morris, 14 at the time, was at school when a group of students were left unattended in the school's gymnasium.
"Morris suffered a vicious beating at the hands of one or more fellow students, a prolonged incident which left him severely and permanently injured," the suit said.
Mark Morris claims the school had a duty to act in a reasonable, prudent manner when undertaking the care, supervision and control of the students.
According to the suit, the school breached its duty to protect Robert Morris, causing the fight and subsequent injuries.
Mark Morris seeks judgment in his son's favor and asks that the school board pay any and all costs and damages.
Attorney Scott Caudill is representing Morris. The case has been assigned to Judge Charles King.
