WINFIELD – An Ohio pool company says two women owe more than $12,000 for a pool it installed last year.
Don Klaiber, doing business as Klaiber Pools in Coal Grove, Ohio, filed the suit Jan. 15 in Putnam Circuit Court against Ann Baker and Monna G. Winkler.
In the complaint, Klaiber says Baker contracted him on May 8, 2007, to install a 5-foot deep pool kit with sand filter, sand, pump and platform base at her residence in Winfield. The $11,500 contract called for 12 yards of concrete, but more than that actually was used. He said Baker agreed to pay for the extra concrete and work. The extra supplies and labor brought the total to $12,700.
Baker has paid $6,500 on the job, Klaiber says. But she still owes $6,200. Klaiber says she has failed and refused to pay the balance.
Klaiber lists Winkler as a defendant because, as owner of the property, she has been wrongfully and unjustly enriched by the installation of the pool in the amount of $6,200.
Klaiber, through Hurricane attorney David L. Hill, seeks $6,200 from each defendant, plus interests, court costs and attorney fees.
The case has been assigned to Circuit Judge O.C. "Hobby" Spaulding.
