James Balser v. Petroleum Fueling, Inc.

* James Balser, of Fayette County, filed a suit against Petroleum Fueling after he was fired. Balser was injured during a truck accident on the job and filed for worker's compensation. Balser claims he was fired because he filed for worker's compensation on injuries ruled compensable. He seeks back pay and employee benefits along with being reinstated to his former position. He also seeks compensatory damages for embarrassment, emotional distress and mental anguish.

Danny L. Henderson v. West Virginia Department of Transportation, Division of Highways

* Danny Henderson, an inmate at the Ohio County Correctional Center, filed a suit against the Division of Highways after he was injured when clearing brush with a work crew. Henderson claims he was cutting tree branches when one fell on him, breaking his leg. He seeks compensation for his injuries.

* Jeff T. Gay, of Upshur County, is seeking $25,000 in medical expenses after his legs were crushed by equipment while working on a well in New York. Gay claims Phoenix Drilling failed to provide a safe wench for the job. Gay claims the company violated safety laws and regulations by failing to properly maintain the wench in a safe working condition. Gay claims he suffered injuries to his back, legs, internal organs, and upper and lower extremities, suffering approximately $25,000 in medical expenses. Gay seeks compensatory damages.

Frances and Kenneth Landers v. Davol, Inc., Herbert J. Thomas Memorial Hospital Association

* Frances and Kenneth Landers filed a suit against Davol, Inc., and Thomas Memorial Hospital, after Frances was given a Kugel Mesh during a hernia operation. The mesh was later recalled. Frances Landers claims she suffered more than $250,000 in medical expenses due to complications from the Kugel Mesh. Kenneth Landers claims he suffered a loss of consortium from his wife, and has become obligated for the payment of her medical bills. The Landers seek compensatory damages for their losses.

Vonda L. Rippitoe v. Jessica J. Davis, Myrna Davis, Jackson Davis

* Vonda Rippitoe filed a suit against Jessica Davis, claiming Davis ran off the road, drove across four lanes and traffic and struck her Aug. 30, 2006. According to the suit, Rippitoe claims she incurred substantial medical bills, loss of earning capacity, pain, suffering, crippling injuries and the loss of ability to enjoy life. She seeks $500,000 from the Davis'.

* Kevin Wiggins filed a suit against All Crane and Equipment Rental Corporation, claiming he was injured when he fell off a broken catwalk. Wiggins claims he sustained severe and grievous bodily injuries as a result of the fall. According to the suit, Wiggins suffered permanent injuries, loss of wages, loss of capacity to earn, loss of enjoyment of life, pain and suffering, mental anguish and disfigurement. He seeks compensatory and punitive damages.

* Jacqueline Miller filed a suit against IGA, claiming she slipped on a substance on the floor of a Kanawha County store and fell. Miller claims she suffered physical injury due to the fall, as well as mental anguish, limitations in her activities and a diminution in her ability to enjoy life. She seeks compensatory and punitive damages

* Tammie Parrish filed a suit against Anderson Equipment Company and her manager, Michael Burke, claiming they allowed a hostile work environment to exist. Parrish claims she was sexually harassed and physically assaulted by a co-worker, Jim Walker, on several occasions. According to the suit, the company and Burke knew of the activities taking place but did nothing to prevent them. Parrish seeks damages for indignity, embarrassment, humiliation, emotional distress, annoyance and inconvenience. She also seeks punitive damages.
