CHARLETSON - A Kanawha County woman filed a suit against Wal-Mart after she was injured when she slipped in a puddle of water at the Southridge store.
Cheryl Sizemore and her husband Homer filed a suit Jan. 24 in Kanawha Circuit Court against Wal-Mart.
According to the suit, Sizemore was shopping with her daughter February 2006 at the South Ridge Wal-Mart. She said she was shopping in the men's department when she slipped on a puddle of water at the end of the aisle.
The suit says the water was from a leak in the sprinkler system and had been there for some time.
Sizemore claims she injured her right leg, hip and back.
According to the suit, the manager of the store was called to the scene and would not let Sizemore sit on a bench or chair inside the store. Sizemore went to Health Plus Urgent care and was diagnosed with cervical and thoracic sprain and strain.
Sizemore suffered medical expenses in excess of $10,000. The suit says Wal-Mart should have known the sprinkler system leaked, which presented a danger to shoppers of the store.
Homer Sizemore claims he has suffered a loss of consortium of his wife.
The Sizemores seek compensatory and punitive damages for injuries and medical expenses.
Attorney Jennifer N. Taylor is representing the Sizemores. The case has been assigned to Judge Louis Bloom.
