Faulty hotel banister leads to fall, lawsuit

CHARLESTON - A suit has been filed against a Days Inn hotel in Teays Valley after a man fell through the balcony on the front porch and was injured.

Randall S. Brewer filed a suit March 11 in Kanawha Circuit Court against CJH Inc., which operated Days Inn.

According to the suit, Brewer was at the hotel May 5, 2006, and was standing on the front porch of the hotel, leaning against a banister or railing.

The suit says the banister was either unsecured or had deteriorated at its base and gave way, causing Brewer to fall to the ground and be injured.

Brewer claims he suffered a torn rotator cuff on his right arm.

According to the suit, Brewer seeks compensatory damages for his injuries and damages.

Attorney Larry O. Ford is representing Brewer. The case has been assigned to Judge Tod Kaufman.
