According to a complaint, the defendant has breached its agreement by failing to make timely payments due to the plaintiff. As a consequence of the defendant's breach of contract, the plaintiff has incurred damages in the amount of $46,829.03. The plaintiff is requesting the owed cost as well as attorney's fees and such other relief as the facts and law and the interests of justice require.

* On June 28, 2008, the plaintiff, a business invitee of the Shepherdstown Street Fest. The defendant, maintained possession and control over King Street between German Street and Queen Alley and German Street between Church and Princess Streets in Shepherdstown. The plaintiff on the aforesaid date fell over wiring, which had been placed by the defendant on German Street. The wiring was neither known nor obvious to the plaintiff and was not a normal or obvious to the use of the premises and is seen as negligence on the part of the defendant. The plaintiff is requesting judgment against the defendant in an amount sufficient to compensate her for the injuries for which she has sustained; pre-judgment interest on all items of ascertainable pecuniary loss up to the date of the trial of this matter, her costs incurred in and about the prosecution of this action; post-judgment interest; attorney fees and for such other relief as the nature of this cause may require.
