Clay woman sues after tripping at Kmart

CHARLESTON -- A Clay County woman has filed a suit against a national retail store after she was injured when she tripped in the store.

Susan Jackson filed the suit Aug. 1 in Kanawha Circuit Court, against Kmart. Jackson's husband, Eric Jackson, is also named as a plaintiff in the suit.

According to the suit, Susan Jackson went to the Elkview Kmart on Aug. 2, 2006. While shopping, she claims a dangerous and unsafe condition on the floor caused her to trip and fall.

Jackson claims she incurred serious physical and mental injuries, some of which are permanent in nature.

According to the suit, Jackson claims she incurred medical bills, physical pain and suffering, permanent disfigurement and scarring, emotional distress and annoyance and inconvenience.

Eric Jackson claims he suffered a loss of consortium from his wife.

The Jacksons seek compensatory and punitive damages.
