Man sues after woman hit him in Wal-Mart parking lot

CHARLESTON - A Kanawha County man has filed a personal injury lawsuit against a woman who hit him with her car in a Wal-Mart parking lot.

Kenneth A. Poe filed the suit Aug. 8 in Kanawha Circuit Court against Katherine N. Lively.

According to the suit, Lively was driving through the Nitro Wal-Mart parking lot when she ran into Poe, running over his left foot. Poe claims he suffered injuries to his left foot and knee and was otherwise injured.

Poe claims he sustained pain and suffering, loss of enjoyment of life, past and future medical expenses, loss of ability to provide household services, permanent residual problems, difficulty sleeping, climbing stairs and walking without assistance.

Poe, who is representing himself, seeks compensatory and punitive damages.

The case has been assigned to Judge Irene Berger.
