MORGANTOWN -– A New Jersey man has filed suit against the city of Westover, claiming he was injured while riding in the back seat of a car after a police officer rear-ended it.
Pierce was in the back seat of a car that was stopped in traffic on Patteson Drive in Morgantown on Oct. 10, 2007, according to the complaint filed in Monongalia Circuit Court.
Nathan Lee Gidley, a Westover police officer, was on duty at the time and rear-ended the vehicle Pierce was riding in, the suit states.
Pierce claims that he was severely injured and can no longer enjoy life.
He has become responsible for medical costs and has suffered annoyance, aggravation and mental anguish, according to the complaint.
Gidley was negligent because he failed to maintain control of his vehicle, the suit states.
Pierce is seeking a judgment that will fairly compensate him for his injuries, plus pre-judgment and post-judgment interest, costs, attorneys' fees and other relief the court deems just.
