Kanawha man sues after fall at McDonald's

CHARLESTON - A Kanawha County man has filed a suit against a national fast-food chain after he slipped and fell at a local location.

Lester Haynes filed the suit Sept. 12 in Kanawha Circuit Court against McDonald's Restaurants of West Virginia.

According to the suit, Haynes was at the McDonald's located at 6414 MacCorkle Avenue in Charleston on Jan. 22, 2008.

Haynes was walking on the sidewalk when he slipped on a portion that was covered with ice, the suit says. Haynes fell and broke humerus in his right arm and suffered additional injuries to his right side, arm and shoulder.

According to the suit, Haynes suffered pain and suffering, medical expenses, and loss of enjoyment of life. He seeks compensatory and punitive damages.

Attorney Lisa DiTrapano Fairless is representing Haynes. The case has been assigned to Judge Paul Zakaib.
