CHARLESTON -- A Greenbrier County couple is suing a moving company, claiming their furniture was destroyed during their move from Florida.
Marty and Shelia O'Boyle hired Superior Moving and Storage to move their furniture from Miami to Greenbrier County on June 11, 2007, according to the complaint originally filed Jan. 5 in Greenbrier Circuit Court.
However, their furniture was "excessively damaged and destroyed" while in Superior's control, the suit states.
"Plaintiff estimated the cost to repair and/or replace the furniture at approximately $49,407.16," the suit states.
After the O'Boyles submitted a claim to the moving company, Superior only offered them $120, the couple alleges.
The O'Boyles are seeking unspecified compensatory damages, plus interest, attorney's fees, costs and other relief the court deems just.
Superior removed the case to federal court because the O'Boyles are seeking more than $10,000 in a civil action against a carrier to recover damages for an alleged injury.
The O'Boyles are represented by Rachel Moreland of Moreland and Moreland in Charleston.
Superior is represented by Samuel F. Hanna of Hanna Law Office in Charleston.
