* Allen, who lives in Buffalo, was an equipment operator, truck driver and general laborer for the defendants at their Eleanor facility. On June 15, 2007, his right foot was extensively injured when he was helping placing a rear-end differential in a truck. He had to have his large toe amputated. He seeks compensatory damages for pain and suffering, mental anguish and suffering, permanent physical impairment, loss of wages and benefits, loss of future earning capacity and benefits, loss of capacity to enjoy life, medical expenses past and future, annoyance and inconvenience, and permanent scarring and disfigurement.
