* Sunnyside is filing a complaint to request a review of what it claims to be illegal and erroneous decisions of the Jefferson County Planning Commission and for declaratory relief. The plaintiff filed a variance request to obtain an extension of time within which to gain approval of a final plat of the Criswood Subdivision. The commission denied the request. Sunnyside claims that the commission failed to notify Sunnyside in writing of its decision and the commission failed to approve and serve upon Sunnyside, which Sunnyside claims to be an erroneous and illegal decison. Sunnyside requests declaratory relief and reverse decision of the Commission and expenses, including costs and attorney fees.
