Woman sues after she and daughter are hit by car

HUNTINGTON -- A Huntington woman is suing an Ohio woman she says struck her and her minor 3-year-old daughter with a car while the pair was crossing a street.

Thalia Byrd, individually and as parent of Cera Byrd, filed a lawsuit July 1 in Cabell Circuit Court against Anita A. Gibson of Lawrence County, Ohio.

The plaintiff says she and her daughter were pedestrians on Ninth Avenue and Eighth Street in Huntington on Dec. 5, 2008, when Gibson drove "recklessly" in her Honda Civic and struck both of them.

Both Byrds were seriously injured as a result, the complaint says, and have incurred medical expenses and suffered emotional distress.

The plaintiff is seeking compensatory and punitive damages.

Robert B. Warner and Tammy Bowles Raines are representing the plaintiff. The case is before Cabell Circuit Judge F. Jane Hustead.
