Justices won't hear wind turbine appeal

CHARLESTON – The state Supreme Court declined to hear an appeal filed by a Greenbrier County couple and a community-based group of West Virginia citizens opposing the construction of 124 wind turbines in southeastern West Virginia.

In a unanimous decision reached during a Sept. 2 hearing, the court rejected appeals Mountain Communities for Responsible Energy and the couple filed against the Public Service Commission's February approval of Beech Ridge Energy LLC's $300 million project.

By giving its authorization, the Public Service Commission said Beech Ridge met all pre-construction conditions outlined in an August 2006 permit, which the Supreme Court has already sustained.
