Man sues after he's hit crossing Huntington street

HUNTINGTON – A man has filed suit against the driver who he says struck him as he was attempting to cross the street.

Terry L. Smith claims he was crossing the street at the intersection of Sixth Avenue and 10th Street in Huntington on May 3 when Alifia Doctor, who was turning left from west on Sixth Avenue to south on 10th Avenue, struck him.

Because of the collision, Smith incurred medical expenses and endured pain, suffering, emotional distress, nuisance and inconvenience, according to the complaint filed Aug. 4 in Cabell Circuit Court.

Doctor negligently failed to drive at a safe speed, failed to yield to pedestrians and failed to operate her vehicle in a safe manner, the suit states.

Smith is seeking an unspecified judgment, plus other relief the court deems just.

R. Lee Booten II of Huntington will be representing him.

The case has been assigned to Cabell Circuit Judge F. Jane Hustead.
