* Alejo was a passenger in a 1995 GMC Safari minivan driven by her husband Hernandez on July 5, 2009, on Interstate 64 when Burgess rear-ended them and caused their van to skid off the road and roll off the highway. Alejo's seatbelt broke and she was ejected. She died from her injuries, leaving four children and her husband. Hernandez seeks compensatory and punitive damages, pre- and post-judgment interest and other relief.
